How do you check and verify if the property you are selling on my behalf really belongs to me?

Ownership of the property will be assessed by our legal experts after going through the property papers provided to us either by you or your representative. That apart we proceed with the task only after your acceptance of our terms and conditions listed in our website and the subscription form.


Can you assist in drafting a sale agreement?

Yes, YMI can assist you in drafting a valid sale agreement and send it for your approval.

How would you assist me in drafting a POA (Power of Attorney)? Can I issue a POA to YMI for handling the task? How can I be sure that you will not misuse the POA?

We would assist you in drafting a POA in following ways

  • We will provide you instruction on how to get a POA done.
  • We will provide you a sample draft of POA.

Yes, you can always issue a POA to YMI for executing the required task on your behalf in India. We will always request for a specific POA towards a particular activity specific to a particular property. On the basis of a specific POA issued, the company shall duly authorize a representative (company employee) to act on behalf of the company & this will be done as per the legal procedures. Powers will be revoked once the desired activity is completed.


What is "adjudication" of POA & why is it required for NRIs (Non Resident Indians)?

The process of getting the POA adjudicated as per the Indian Stamp Act is called "Adjudication". All POA's issued in foreign countries, due the NRI being resident outside India have to be adjudicated to make it a legally accepted document for any property transaction in India.


Do you charge separately for drafting the sale agreement/POA adjudication?

If you have subscribed to our selling assistance package we will not be charging any service fee for drafting the sale agreement and assistance on POA. All the fees towards the adjudication of the POA (if required in your case) will be separate and will be charged on actual cost basis.

Can you assist me in procuring property documents that are mandatory, but not available with me? If yes what would be the charges?

Yes we can assist you in procuring such property documents that are mandatory but not available with you. YMI can work towards getting those documents issued from the respective issuance authorities. YMI will not charge any service fee for this issuance, however all procurement charges and government fees wherever applicable will be separate and will be billed on actual cost.

I am an NRI and in case I want to come to India for registration, can you assist me with travel arrangements?

Yes we can take care of your travel arrangements. There will be an additional charge towards this activity and it will be intimated separately while we process your requirements.

What are the various steps involved in sale deed registration process?

Sale deed registration* process differs from state to state within the country. Following are the few common steps that are followed at the time of sale deed registration

  • Convenient date for registration will be fixed after checking with the Seller / POA holder (in case if it is issued) and the Buyer.
  • Coordination with the sub-registrar office in terms of the documentation requirement for registration and intimation of the same to the Seller / POA Holder and the Buyer
  • Registration time will also be checked and intimated to the Seller / POA Holder and the Buyer.
  • Registration charges like stamp duty, service tax, etc will have to be borne by the buyer and it has to be paid to the sub-registrar office at the time of registration. Mode of payment will be discussed and the payments will be settled by the Buyer to the Seller / POA Holder at the time of registration.

Can you provide me with a checklist of all the property documents required at the time of registration?

The list of document required to complete the sale registration process differs from state to state and will vary based on the regulations issued from time to time. Before registration, YMI will check with the concerned sub-registrar's office on the documentation requirement and the details will be communicated to the seller & buyer.

Who would be available for assistance from YMI at the time of registration in case POA is issued to my local contact or if I choose to be physically present?

Our executive will be available at the time of registration in order to provide instant guidance and support to the POA holder/yourself. YMI will be present to coordinate with all the concerned parties to the transaction at the time of registration and ensure a smooth transfer.

What constitutes official completion of the sale? Does YMI's job end with the completion of sale deed registration?

The sale process is considered to be completed only when the sale registration gets completed at the sub-registrar's office. YMI's job does not end with getting the sale deed registered. After registration, the copy of the sale deed will be collected and delivered to you.

You have mentioned that you would assist in assessing capital gains due to the sale? Do you charge separately for such assessment?

YMI would provide you with assistance and advice on assessing capital gains in consultation with empanelled tax experts. If you have subscribed to the Selling Assistance Package, then there will be no extra service fees charged for the coordination. However, professional advice from tax experts will be charged extra and the work will be undertaken only on your approval.

How would you collect the payment from the buyer & how would it reach me? How would I know that the amount has been credited into my account? (applicable if POA is issued in favor of YMI)

We will collect the payment through Banker's Cheque or Demand Draft at the time of registration and it will be deposited into your Bank Account. We will send you a scanned copy of bank challan / acknowledgement along with the copy of the draft / bankers cheque. You need to confirm the receipt of payment to us through an email.

How would you send me a copy of the sale deed after registration? Is international shipping free?

We will send the document through courier to your address. Courier fees will be charged extra only if the shipment is to an international destination. We will provide you the courier dispatch number / POD no. so that you can track the status of the shipment.

When & how would I receive updates about the status of my order?

You would be receiving updates on your order/(s) on a regular basis from YMI. All the updates based on the progress of the order will be sent to you through email / website.

What if the buyer commits a breach of contract? What role would you play in safeguarding my interests?

In case of a legal breach of contract from seller's end, YMI's legal team will review the contract and will suggest various possible legal options to safeguard your interests. However, you have the option to take recourse to legal remedies for enforcing the contract on your own without assistance from YMI.
