Mutation of Property (ancestral) in Chennai for a Person of Indian Origin in USA.

Ram Prakash (name changed) is a PIO who runs his own consultancy firm in NY, after having worked in key positions for many large corporations. He left for the US during his student days and ever since has been living in the US.

While Ram still has an old mother living in Bangalore, a couple of years back he found himself as the beneficiary of estate in Chennai left behind by his unmarried uncle. His uncle left behind property to Ram and his cousin. Ram was clueless about the transfer formalities and regulations on inherited property. He had to transfer the property to his name. The process of transferring ownership from one person to another is referred to as Mutation.

One of the requirements for mutation of ancestral property was to obtain a probate of the will from the court and submit it along with the death certificate of the person leaving behind the estate. Ram contacted a lawyer friend for help who assured him assistance. While the task dragged on for months and the cost kept escalating, the personal relationship with the lawyer complicated matters for Ram. He could not insist on completion within a specific time frame or demand justification of the costs. Finally, he got fed up and decided to contact a professional service like YMI since he had used our services for other matters in Bangalore.

YMI quickly provided a check list of things required to complete the task. Ram was unsure if he had a copy of the will probate. After evaluating various options, we requested Ram to first check with his cousin on the will probate. He did as suggested. Fortunately, she had a copy though the original was in the custody of a bank.

Our Chennai team moved in quickly to obtain a copy and got the death certificate attested by a notary. They also applied to the registrar office on Ram's behalf and obtained a copy of the original parent document of title. Now with the attested will probate, death certificate, parent document and the rest of the required property documents that proved undisputed title ownership of Ram's uncle over the property in question since 1953, our team applied to the Chennai City Corporation. The requisite fee for mutation was paid and the name transfer was completed.

Ram was now, the legitimate owner of the property he had inherited.

But the job was still incomplete. Next YMI took on the task of transferring the electrical connection with the Tamilnadu Electricity Board, and then followed it by getting the water connection transferred at the Chennai Metropolitan Water Supply & Sewerage Board.

With the job done, Ram was now free to rent out the property legitimately or use it during his visits to India.

All this was completed by YMI with a specific power of attorney issued by Ram in just 3 months. Ram never had to make a trip to India for this purpose. YMI's Chennai team had pulled off something that he could not accomplish in a year with help from a friend. The job was efficiently handled and he was kept informed on the progress at every stage. No wonder, Ram thought that it was nothing short of a miracle to accomplish it in such short time.
